The California Medical Association (CMA) has given in to pressure from the Gay and Lesbian Medical Association and withdrew their friend-of-the-court brief, defending a doctors' right to refuse to administer treatment on "moral grounds."
The case began when Guadalupe Benitez, a San Diego lesbian, requested a referral from her health care provider, Dr. Christine Brody, for artificial insemination. Dr. Brody indicated she could not do so out of conscience but did refer Benitez to another physician. Benitez sued Dr. Brody and the healthcare practice, North Coast Women's Care Medical Group.
The revised CMA brief, prepared in conjunction with Kaiser Permanente, states "Physicians who offer a given service to the public may not decline patients because of race, color, religion, national origin, sexual orientation, or other bases which constitute individual discrimination. These standards are applicable regardless of the religious or ethical beliefs of the physician."
The state of California civil rights laws make it illegal for Christians to remain faithful to their conscience. The courts ruled that patients can sue health care providers who "discriminate" based on sexual orientation. The case will proceed to trial.
