Thousands of organizations rent space from the New York City public schools during off-hours. But the NYC School Board has singled-out churches by excluding them from utilizing the public facilities. The United States Department of Justice Civil Rights Division has supported a lawsuit filed by the Alliance Defense Fund, claiming the NYC School Board practices unconstitutional discriminatory policies against churches. The DOJ brief states "the city's exclusion of religious worship from its otherwise extremely broad access policy violates the First Amendment."
