The decision whether to transfer a memorial bearing a large cross to the federal government was put before the citizens of San Diego, who overwhelming voted in favor of the move. This memorial has been in the courts numerous times. The latest judicial u-turn comes from Superior Court Judge Patricia Yim Cowett. Cowett has issues a restraining order against the initiative that was voted for, questioning the constitutionality of the transfer.
Charles LiMandri, attorney for the Thomas More Law Center, noted "We tried to do everything according to the rules, but they keep on changing the rules. This is like moving the goal post."
