Michelle McCusker was a pre-kindergarten teacher at the Diocese of Brooklyn and St. Rose of Lima school in Queens, New York. When McCucker, a single woman, informed the principle that she was three months pregnant with no intentions of marrying the father, she was asked to leave the school on the grounds that being unmarried and pregnant was the wrong role model for the Catholic school to present to school children.
The New York Civil Liberties Union (NYCLU) sued the school, citing federal law banning discrimination against pregnant women. NYCLU recommended, to make this practice nondisciminatory, that the school monitor the sex lives of the male teacher for other unwed pregnancies.
